P.C. 1003 – Aggravated Assault
Description:
Aggravated Assault occurs when a person unintentionally yet recklessly causes bodily injury to another individual during a confrontation. This charge applies when the aggressor’s actions demonstrate a disregard for safety, resulting in significant harm—even if there was no intent to injure.
Examples:
- Shoving someone during an argument, causing them to fall and break a bone
- Recklessly swinging fists in a crowd and injuring a bystander
- Engaging in a heated confrontation that escalates and leads to serious injury
Classification:
- Felony
Punishment Guidelines:
- Jail time: 20 minutes
- Fine: $1,250
- Possible probation or parole restrictions depending on severity
Notes:
- If a weapon is involved, escalate to P.C. 1004 – Assault with a Deadly Weapon
- If the victim is a protected class (e.g., law enforcement, EMS, government official), consider enhancement under P.C. 1010 – Assault on Protected Personnel
- Intentional harm without a weapon may fall under P.C. 1002 – Assault
