P.C. 1005 – Involuntary Manslaughter
Description:
Involuntary Manslaughter occurs when a person unintentionally and recklessly causes the death of another individual. This charge applies when the offender’s actions demonstrate a disregard for human life or safety, resulting in fatal consequences, even though there was no intent to kill.
Examples:
- Driving recklessly and causing a fatal accident
- Engaging in dangerous behavior (e.g., firing a gun into the air) that leads to someone’s death
- Failing to act responsibly during a confrontation that escalates fatally
Classification:
- Felony
Punishment Guidelines:
- Jail time: 60 minutes
- Fine: $7,500
Notes:
- If the act was intentional, escalate to P.C. 1005.1 – Voluntary Manslaughter or TBD
- If the death occurred during the commission of another felony, consider Felony Murder Rule enhancements
- May be reduced to a lesser charge if mitigating circumstances are present
