Description:
Vehicular Manslaughter occurs when a person unintentionally and recklessly causes the death of another individual through the operation of a motor vehicle. This includes driving behaviors that show a disregard for safety, such as excessive speeding, reckless driving, or driving under the influence, resulting in a fatal accident.
Examples:
- Speeding through a red light and fatally striking a pedestrian
- Driving under the influence and causing a fatal crash
- Recklessly swerving through traffic and causing a collision that results in death
Classification:
- Felony
Punishment Guidelines:
- Jail time: 75 minutes
- Fine: $7,500
Notes:
- If the act was intentional, escalate to P.C. 1007 – Murder (Second Degree)
- If no death occurred, consider P.C. 2002 – Reckless Driving or P.C. 2003 – DUI
- May be enhanced if multiple fatalities or aggravating factors are present (e.g., fleeing the scene)
