P.C. 1009 – Accessory to Second Degree Murder
Description:
A person is guilty of Accessory to Second Degree Murder when they are present during, assist with, or participate in the commission of a Second Degree Murder, without being the primary actor. This includes aiding, encouraging, or failing to prevent the act when capable of doing so.
Examples:
- Helping the offender escape after the murder
- Providing weapons or tools used in the killing
- Actively participating in the assault that led to the death
Classification:
- Felony
Punishment Guidelines:
- Jail time: 50 minutes
- Fine: $5,000
Notes:
- If the individual planned or directly committed the murder, charge under P.C. 1008 – Second Degree Murder
- If the murder was premeditated, consider P.C. 1011 – Accessory to First Degree Murder
- May be enhanced if the accessory attempted to conceal evidence or mislead law enforcement
