P.C. 1010 – First Degree Murder
Description:
First Degree Murder is defined as the intentional, willful, and premeditated killing of another individual, carried out with malice aforethought. This charge applies when the offender planned the act in advance and executed it with the clear intent to end a life.
Examples:
- Luring someone to a location with the intent to kill
- Planning and executing a targeted shooting
- Administering poison with the intent to cause death
Classification:
- Felony
Punishment Guidelines:
- Jail time: 150 minutes
- Fine: $25,000
Notes:
- If the killing was intentional but not premeditated, consider P.C. 1008 – Second Degree Murder
- If the offender assisted but did not commit the act, consider P.C. 1011 – Accessory to First Degree Murder
- May be enhanced if committed against protected personnel or during the commission of another felony
