P.C. 1002 – Assault
Description:
A person commits Assault (No Weapon) when they intentionally or recklessly cause physical harm or offensive contact to another individual without the use of any weapon. This includes actions such as punching, kicking, slapping, or any other form of bodily attack that does not involve an object or weapon.
Examples:
- Engaging in a fistfight
- Slapping or pushing someone during an argument
- Kicking a person during a confrontation
Classification:
- Misdemeanor (if minor injury or first offense)
- Felony (if repeated offense or serious bodily harm)
Punishment Guidelines:
- Misdemeanor: Up to 10 minutes jail time, fine up to $850
- Felony: See P.C. TBD
Notes:
- If a weapon is involved, escalate to P.C. TBD – Assault with a Deadly Weapon
- If the victim is a government official, law enforcement, or emergency personnel, consider enhancement under P.C. TBD – Aggravated Assault
