P.C. 1004 – Assault with a Deadly Weapon
Description:
A person commits Assault with a Deadly Weapon when they intentionally, knowingly, or recklessly cause bodily injury to another individual and either:
- Cause serious bodily injury, or
- Use or exhibit a deadly weapon during the assault.
This includes firearms, knives, blunt objects, vehicles, or any item used in a manner capable of causing death or serious harm.
Examples:
- Striking someone with a bat or crowbar
- Brandishing a firearm during a fight and causing injury
- Using a vehicle to hit someone intentionally or recklessly
Classification:
- Felony
Punishment Guidelines:
- Jail time: 30 minutes
- Fine: $3,750
Notes:
- If no weapon is used and injury is minor, consider P.C. 1002 – Assault
- If the assault was unintentional but reckless, consider P.C. 1003 – Aggravated Assault
- If the victim is a protected individual (e.g., law enforcement, EMS), apply enhancements under P.C. 1010 – Assault on Protected Personnel
