P.C. 1008 – Second Degree Murder
Description:
Second Degree Murder is defined as any intentional killing that is not premeditated or planned, but still involves a deliberate act. This charge applies when the offender intends to cause serious bodily harm and death results from that act, even if the intent to kill was not explicitly formed beforehand.
Examples:
- Beating someone severely during a fight, resulting in death
- Shooting someone in a fit of rage without prior planning
- Intentionally causing harm that leads to fatal injuries
Classification:
- Felony
Punishment Guidelines:
- Jail time: 100 minutes
- Fine: $15,000
Notes:
- May be enhanced if committed against protected personnel or during the commission of another felony
- If the act was premeditated, escalate to P.C. 1010 – First Degree Murder
- If the death was unintentional, consider P.C. 1005 – Involuntary Manslaughter or P.C. 1006 – Vehicular Manslaughter
